Terms of service

These terms govern your use of yourmemoires.com and any order you place through it. By browsing the site or placing an order, you agree to them. Please read them alongside our Refund Policy, Shipping Policy and Privacy Policy, which form part of these terms.

1. Who you are dealing with

This store is operated by Memoires, a business registered in the Netherlands under Chamber of Commerce (KvK) number 76169502, VAT number NL003057743B62. You can reach us at contact@yourmemoires.com. Full details are on our Legal Notice page.

Throughout these terms, "we", "us" and "Memoires" mean that business. "You" means the person using the site or placing an order.

2. Using the site

You must be at least 18 years old, or have the consent of a parent or guardian, to place an order. You agree not to use the site for any unlawful purpose, not to attempt to gain unauthorised access to it, and not to interfere with its operation or security.

3. Orders and acceptance

Adding items to your cart and completing checkout is an offer to buy. A contract is formed when we send you an order confirmation email. We may decline or cancel an order — for example if an item cannot be produced, if a price or description was clearly wrong, or if we suspect fraud. If we cancel an order you have already paid for, we refund it in full.

Because items are printed to order, orders enter production quickly. Cancellation and change requests are handled as described in the Refund Policy.

4. Prices and payment

All prices are shown in US dollars and include shipping to the United States. Any applicable sales tax is calculated at checkout.

Quantity discounts are applied automatically at checkout and count every mug in your cart, regardless of size or design. Discounts cannot be exchanged for cash and apply only to orders placed while they are active.

We may change prices at any time. A price change never affects an order we have already confirmed. Payment is taken at checkout through our payment provider; we do not store your full card details.

5. Products, prints and colour

We describe our products as accurately as we can, but screens differ and printing is a physical process. Small variations in colour, print position and finish between the images on the site and the mug you receive are normal and are not a defect. Mugs are individually printed, so no two are identical down to the millimetre.

Capacities and dimensions listed on product pages are nominal and subject to normal manufacturing tolerance.

Care instructions on the product page are part of the product description. Damage caused by use outside those instructions is not covered by the Refund Policy.

6. Custom and personalised orders

If you supply text, a photo or artwork for a personalised mug, you confirm that you own the rights to it or have permission to use it, and that it does not infringe anyone's copyright, trademark, privacy or other rights.

You grant us a limited licence to reproduce that content for the sole purpose of producing and delivering your order. We do not use customer-supplied artwork in our own catalogue, marketing or sample products without asking you first.

We may refuse any personalisation request that we consider unlawful, infringing, hateful, threatening, sexually explicit, or otherwise inappropriate. If we refuse an order for this reason, we refund it in full.

Personalised items are checked for print quality but not for spelling. Please proofread what you submit — a typo you supplied is not a defect.

7. Our intellectual property

All designs, illustrations, photographs, text and other content on this site are owned by Memoires or used under licence. You may not copy, reproduce, resell or redistribute them, or use them to produce goods of your own, without our written permission. Buying a mug gives you the mug, not rights to the artwork on it.

8. Availability

We try to keep the site accurate and available, but we do not guarantee uninterrupted access. We may change, suspend or withdraw products or parts of the site at any time. Content on the site is provided for information; we do not warrant that it is free of errors.

9. Liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited under applicable law.

Subject to that, our total liability arising out of any order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss, including lost profits or lost opportunity, or for delays caused by carriers, weather or other circumstances beyond our reasonable control.

10. Third-party links and services

The site may link to third-party websites and relies on third-party services for payment, fulfilment and analytics. We are not responsible for the content or practices of those third parties. Our handling of your data is described in the Privacy Policy.

11. Changes to these terms

We may update these terms from time to time. The version published on this page at the moment you place an order is the version that applies to that order. Material changes take effect when they are posted here.

12. Governing law

These terms are governed by the law of the Netherlands. Disputes may be brought before the competent court in the Netherlands. If you are a consumer, this does not deprive you of the protection of mandatory consumer law in your place of residence.

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions stay in force.
